Terms & Conditions

Please read before booking: 

These Terms apply to all rentals and services provided by Kenmar Event & Party Rental LLC, referred to as “Kenmar.” The person placing the order is referred to as the “Customer.”

The Customer must accept these Terms through a required checkout box or electronic signature before delivery. Georgia generally recognizes electronic records and signatures when the parties agree to transact electronically.  

RESERVATIONS & PAYMENT

 

A non-refundable reservation retainer is required to secure the event date and rental inventory. The retainer is applied toward the total order balance as breakdown below: 

  • Orders of $100 or less: full payment at booking.

  • Orders over $100: a 50% Reservation Payment at booking.

  • Orders booked fewer than 48 hours before delivery: full payment at booking.

Inventory is not reserved until Kenmar receives the retainer and confirms the booking.

The remaining balance is due no later than 48 hours before scheduled delivery, unless a different deadline appears on the invoice or rental agreement. Kenmar may withhold delivery or release reserved inventory when payment is not received by the deadline.

DELIVERY & PICK UP

Scheduled delivery and pickup are:

  • $50 within 15 miles

  • $75 for locations 16–25 miles away 

Locations beyond 25 miles require a custom quote.

Distance is calculated from Kenmar’s business location to the delivery address. The delivery fee is charged once per order. Kenmar may verify the address and correct an incorrectly selected delivery zone before delivery.Standard delivery includes ground-level drop-off in an accessible area and one scheduled pickup.

Standard delivery does not include setup, breakdown, stairs, elevators, backyard or room placement, long carries, waiting time, difficult access, or additional trips.

SETUP & BREAKDOWN 

Setup and breakdown must be requested and approved in advance.

Setup only

  • Tables: $2 per table

  • Chairs: $1 per chair

  • Minimum setup charge: $25

Setup and breakdown

  • Tables: $4 per table

  • Chairs: $2 per chair

  • Minimum setup-and-breakdown charge: $50

These rates apply to ordinary, accessible, ground-level layouts. Additional labor for difficult access, venue restrictions, long carries, or complex layouts will be disclosed for approval before service whenever reasonably possible. Setup does not include decorating, linen installation, venue cleaning, moving venue furniture, or handling customer-owned items.

CHANGES, CANCELLATIONS & RESCHEDULING

All order changes are subject to availability and Kenmar’s written approval.

Rescheduling requests must be submitted at least three calendar days before scheduled delivery.

An approved rescheduling request:

  • May be used once

  • Is subject to availability

  • Must be used within six months of the original event date

  • May be subject to current prices and additional service charges

Requests submitted fewer than three calendar days before delivery are not guaranteed and may be treated as cancellations.Reductions made fewer than three calendar days before delivery may not reduce the amount due because the inventory has already been reserved.

 

If Kenmar cancels the entire order because it cannot perform and cannot provide a mutually accepted substitute or rescheduled date, Kenmar will refund payments for the unprovided order, including the reservation retainer.

INSPECTION & CUSTOMER RESPONSIBILITY

The Customer must inspect the equipment at delivery and promptly report missing items, incorrect quantities, or visible damage.Unless a problem is reported at delivery or within one hour, the equipment will be considered received in acceptable condition and in the quantities listed on the delivery record.

The Customer is responsible for all rented equipment from delivery until it is collected by Kenmar.The Customer must keep all equipment secure, dry, supervised, and protected from theft, misuse, rain, mud, fire, standing water, strong winds, and other damaging conditions.

Equipment may not be altered, painted, repaired, stapled, nailed, drilled, or permanently marked without Kenmar’s written approval.

DAMAGE, LOSS & CLEANING

The Customer is financially responsible for equipment that is:

  • Lost, stolen, missing, or not returned

  • Destroyed or damaged beyond normal wear

  • Misused

  • Returned in a condition requiring extraordinary cleaning or repair

Kenmar may charge the reasonable documented repair cost or, when repair is impractical, the reasonable current replacement cost. Normal wear does not include burns, tears, punctures, mildew, water damage, wax, permanent stains or markings, broken frames, bent legs, or missing parts.

Normal laundering of linens is included. Linens must be shaken free of food, trash, wax, confetti, and debris and kept dry. Additional charges may apply for burns, tears, mildew, wax, permanent stains, missing linens, or other damage beyond ordinary use.

PICKUP READINESS & ADDITIONAL CHARGES

Unless breakdown service was purchased, tables and chairs must be folded, reasonably clean, dry, gathered together, and ready in the agreed accessible pickup location.

Additional charges may apply when equipment is inaccessible, still in use, not ready, requires excessive cleaning, causes excessive waiting, requires another trip, or is retained beyond the agreed rental period.

Additional charges include:

  • Waiting after the first 15 minutes: $25 per additional 30 minutes

  • Additional delivery or pickup trip: the applicable delivery fee

  • Extended rental: up to the regular daily rental rate for each additional day

  • Parking, toll, permit, loading, or venue charges: actual cost

  • Cleaning, repair, or replacement: reasonable documented cost

These charges are intended to compensate Kenmar for additional costs rather than act as penalties. Georgia permits contractual damage amounts when legally valid, but unreasonable penalty-style charges can create enforceability concerns.  

WEATHER, VENUE ACCESS & SAFETY 

The Customer is responsible for providing a safe, lawful, dry, and accessible location for delivery, use, and pickup. The Customer must disclose stairs, gates, elevators, parking restrictions, long carries, venue requirements, and unusual access conditions before booking.

Rental equipment must not remain exposed to rain, standing water, mud, severe wind, fire, or other unsafe conditions.

Kenmar may delay, modify, suspend, or cancel delivery or setup when conditions are unsafe for people, vehicles, or equipment. No weather-related refund is required after equipment has been delivered.

The Customer must stop using any item believed to be damaged, unstable, defective, or unsafe and notify Kenmar promptly.

LIABILITY & INDEMNIFICATION

To the fullest extent permitted by law, Kenmar is not responsible for indirect, incidental, special, consequential, or lost-profit damages arising from event interruption, delayed service, unavailable equipment, or the use or misuse of rental equipment.

Kenmar is not responsible for injury, loss, or property damage caused by Customer or guest misuse, unsafe site conditions, weather, unauthorized relocation, improper supervision, or the acts of venues, vendors, guests, or other third parties.

The Customer agrees to indemnify and hold Kenmar and its owners, employees, contractors, and agents harmless from third-party claims arising from the Customer’s possession or misuse of the equipment, unsafe conditions under the Customer’s control, or breach of these Terms.

This section does not exclude liability that cannot lawfully be excluded and does not require the Customer to indemnify Kenmar for Kenmar’s gross negligence or willful misconduct.

CIRCUMSTANCES BEYOND KENMAR'S CONTROL 

Kenmar is not liable for delays or failure caused by circumstances beyond its reasonable control, including severe weather, natural disasters, accidents, road closures, government action, public emergencies, utility interruptions, or vehicle failure despite reasonable maintenance.

Kenmar will make reasonable efforts to provide a substitute, rescheduled service, credit, or refund for items or services that were not provided.

PHOTOGRAPHS & PRIVACY 

Kenmar may photograph its equipment, delivery process, or completed setup for records and marketing. Kenmar will make reasonable efforts not to display private addresses, house numbers, license plates, customer names, or identifiable individuals without permission.

Customers who do not want their setup photographed for marketing must notify Kenmar in writing before delivery.

AGREEMENT, GOVERNING LAW & PRIORITY 

These Terms are governed by Georgia law. Any legal proceeding must be brought in a court with proper jurisdiction and venue under applicable Georgia law. Confirm the appropriate Georgia county with counsel before adding a specific county requirement.

These Terms, the signed rental agreement, confirmed invoice, order confirmation, and approved written addenda form the parties’ agreement.

If provisions conflict, the following order controls:

  1. Signed written addendum

  2. Signed rental agreement

  3. Confirmed invoice or order

  4. These Terms and Conditions

  5. Website FAQ

The FAQ is provided for general customer information and does not replace these Terms.

If any provision is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
